Audi vs. AUDI: Why China-only EVs have sparked a legal headache in Germany

A curious story has been making the rounds in the automotive world: German automaker Audi is reportedly taking legal action to stop an independent parallel importer from bringing two China-built SAIC AUDI electric models — the AUDI E5 Sportback and AUDI E7X — into Germany.

These are not conventional Audi models. Developed jointly by SAIC and Audi specifically for the Chinese market, they wear the AUDI name in capital letters instead of Audi's familiar four-ring logo.

So why would a pair of China-only EVs have become such a headache for Audi in Germany?

Different positioning, same concern

The new EVs developed by SAIC and Audi were never intended to follow the same formula as Audi's traditional European models.

They use a new EV platform developed specifically for the Chinese market, drop the familiar four-ring badge and adopt a design language that is quite different from Audi's existing European range.

On paper, there should be little overlap between the two line-ups. The problem is that these AUDI-badged EVs were not officially approved for sale outside China.

Once independent importers started bringing them into Europe, however, the situation became rather less straightforward.

Take the E5 Sportback and E7X as examples. The AUDI E5 Sportback starts at RMB 235,900 in China. After shipping, local certification, taxes and other costs, parallel-imported cars can cost more than €60,000 (around RMB 460,000) in Germany.

That effectively doubles the price compared with China, but it can still look relatively attractive next to Audi's European EVs, some of which are priced close to or above €100,000, such as the Audi SQ6 e-tron and S6 e-tron.

That price gap could create an awkward situation for Audi. Parallel-imported AUDI models could put pressure on the pricing of Audi's own EVs while also creating complications for its authorised dealer network and e-tron product strategy in Germany.

Audi clarifies its position

SAIC AUDI head Xie Shiqi and the company have since sought to clarify what is actually happening.

According to the clarification, the issue is not an attempt to block the cars from entering Germany altogether. Rather, Audi's official network cannot provide after-sales support or warranty coverage for vehicles brought in through unofficial parallel-import channels.

The company has also reserved the right to take legal action over what it considers misleading or out-of-context reports.

For buyers, that distinction is important.

Because these cars are imported independently, Audi Germany and its authorised dealers cannot provide the same technical support, servicing and repairs available for officially sold models. In the local market, they are treated as third-party vehicles rather than official Audi products.

A question of price, choice and support

For buyers, the appeal is obvious: even after the extra costs of importing them into Germany, these China-market AUDI EVs can still sit well below some of Audi's European electric models.

The trade-off is also clear. Buyers get access to a model that was never officially sold in the market, but give up the after-sales and warranty support that comes with an official Audi.

That leaves the AUDI E5 Sportback and E7X in an unusual position: built for China, but now turning up in Europe through a route Audi never intended for them.
